These Terms of Use ("Terms") govern your access to and use of the Profit Leak Finder™ assessment and related websites and services (collectively, the "Service") operated by Eric B. Horn Career & Business Solutions ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. The Assessment and Results

The Profit Leak Finder™ assessment is an educational, self-diagnostic tool. Your score, category, and recommended next moves are generated based on the answers you provide and are intended for general informational purposes only. Results are not a substitute for professional business, financial, legal, tax, or accounting advice. You are solely responsible for any decisions you make based on the results.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Submit false, misleading, or another person's information without authorization.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or related systems.
• Scrape, copy, resell, or use automated means to access the Service without our written permission.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.

4. Intellectual Property

The Service, including the Profit Leak Finder™ name, assessment questions, scoring framework, recommendations, copy, design, graphics, and other content, is owned by Eric B. Horn Career & Business Solutions and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own internal, non-commercial evaluation purposes. All other rights are reserved.

5. User Submissions

By submitting information through the Service, you grant us a worldwide, royalty-free license to use that information as necessary to provide and improve the Service, contact you about your results, and, in aggregated and de-identified form, to develop benchmarks and educational content. You represent that you have the right to submit the information you provide.

6. Third-Party Links and Services

The Service may link to third-party websites or tools, including a scheduling platform used to book strategy calls. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE ANY PARTICULAR OUTCOME OR FINANCIAL RESULT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ERIC B. HORN CAREER & BUSINESS SOLUTIONS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

9. Indemnification

You agree to defend, indemnify, and hold harmless Eric B. Horn Career & Business Solutions and its owners, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination will survive.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. The updated version is indicated by a revised effective date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
